SELLER TERMS AND CONDITIONS.

a. The Merchant hereby agrees to allow Customers to pay the Net Sales for an Order using usper.

b. The Merchant hereby agrees to extend the Discount to Customer in accordance with the terms set out in the Form and these Terms.

c. The Merchant will determine the Discount via the Brusper Dashboard, which will be nouredby the Merchant until disabled.

d. The Merchant hereby permits Brusper to advertise and offer the Discount to the Customer onbehalf of the Restaurant.

e. The Merchant hereby authorizes Brusper to collect Net Sales and Tips (if any) from Customer on behalf of the Merchant.

f. The Merchant shall extend the Discount to all Customers.

g. The Merchant hereby agrees not to extend any offer/discounts similar or lower to the Discount agreed during the period of its validity to the Customer directly or through any third party.

h. The Merchant shall not, directly or indirectly discriminate, discourage, solicit or refuse aCustomer from availing the Discount or from making payment of the Net Sales using Brusper Pay.

i. The Merchant hereby agrees that where it levies service charge at its Restaurant, it shall apply the same uniformly to all the customers availing services of the Restaurant and shall not in any event discriminate in levying the service charge between a Brusper Customer and any other customer.

j. The Merchant permits Brusper to deduct the Commission from the Net Sales and transfer such remaining amounts to the Merchant in accordance with the payment settlement process set out in the Form.

k. The Merchant will not charge any additional amount, over and above the Net Sales, from the Customer paying the Bill using Brusper Pay.

l. The Merchant shall ensure that all mandatory information pertaining to taxes, levies and charges applicable on the Bill are clearly visible to the Customers on the Bill as per applicable laws.

 

m. The Merchant hereby permits Brusper to contact the Merchant by phone, email, SMS, orother modes of communication, for the purpose of giving feedback or for the purpose of facilitation of any issue in connection with the terms of the Form and these Terms.

n. The Merchant and its representatives shall honour the Discount requested by a Customer irrespective of the number of people seated on the table. For the purpose of clarity, all individuals seated on the table are not required to be Customers (as defined in these terms).

For All Payments

         All payments made against the Orders or Services on the Platform by you shall be compulsorily in Indian Rupees acceptable in the Republic of India. The Platform will not facilitate transactions with respect to any other form of currency with respect to the Orders or Services made on Platform. You can pay by (i) credit card or debit card or net banking; (ii) any other RBI approved payment method at the time of booking an Order; or (iii) cash at the time of delivery (iv) or credit with the merchant (account), but this deal is between buyer and merchant, Brusper is not responsible for both the ends. You understand, accept and agree that the payment facility provided by Brusper is neither a banking nor financial service but is merely a facilitator providing an electronic, automated online electronic payment, receiving payment on delivery, collection and remittance facility for the transactions on the Platform using the existing authorized banking infrastructure and credit card payment gateway networks. Further, by providing payment facility,Brusper is neither acting as trustees nor acting in a fiduciary capacity with respect to the transaction or the transaction price.

   Buyers acknowledge and agree that Brusper acts as the Merchant's  and PDP’s payment agent for the limited purpose of accepting payments from Buyers/Merchants on behalf of the Merchant or PDP(Product details page), as the case may be. Upon your payment of amounts to us, which are due to the Merchant or PDP, your payment obligation to the Merchant or PDP for such amounts is completed, and we are responsible for remitting such amounts to the Merchant or PDP. You shall not, under any circumstances whatsoever, make any payment directly to the Merchant for Order bookings or to the PDP for delivery of the Order or completion of the Task made using the Platform. 

    Buyer agrees to pay for the total amount for the Order placed on the Platform. Brusper will collect the total amount in accordance with these Terms of Use and the pricing terms set forth in the applicable listing of product or restaurant service for the particular Merchant, apart from the delivery fees for Delivery Services. Please note that we cannot control any amount that may be charged to Buyer by his/her bank related to our collection of the total amount, and we disclaim all liability in this regard.

     In connection with Buyer’s Order, he/she will be asked to provide customary billing information such as name, billing address and credit card information either to us or our third  party payment processor. Buyer agrees to pay us for the Order placed by you on the Platform, in accordance with these Terms, using the methods described under clause VIII (6) above. Buyer hereby authorizes the collection of such amounts by charging the credit card provided as part of requesting the booking, either directly by us or indirectly, via a third party online payment processor or by one of the payment methods described on the Platform. If Buyer is directed to our third-party payment processor, he/she may be subject to terms and conditions governing use of that third party’s service and that third party’s personal information collection practices.

Please review such terms and conditions and privacy policy before using the Platform services.Once the Order is confirmed you will receive a confirmation email summarizing the confirmed booking.

 

Ownership of Brusper Content and Proprietary Rights.

   a. We are the sole and exclusive copyright owners of the Services and our Content. We also exclusively own the copyrights, trademarks, service marks, logos, trade names and other intellectual and proprietary rights throughout the world (the "IP Rights") associated with the Services and Brusher Content, which may be protected by copyright, patent, trademark andother applicable intellectual property and proprietary rights and laws. You acknowledge that the Services contain original works and have been developed, compiled, prepared, and arranged by us and others through the application of methods and standards of judgment developed and applied through the expenditure of substantial time, effort, and money and constitutes valuable intellectual property of us and such others. You further acknowledge that the Services may contain information which is designated as confidential by Brusper and that you shall not disclose such information without Brusper's prior written consent.

 

b. You agree to protect Brusper's proprietary rights and the proprietary rights of all others having rights in the Services during and after the term of this agreement and to comply with all reasonable written requests made by us or our suppliers and licensors of content or otherwise to protect their and others' contractual, statutory, and common law rights in the Services. You acknowledge and agree that Brusper (or Brusper's licensors) own all legal right, title and interest in and to the Services, including any IP Rights which subsist in the Services (whether those rights happen to be registered or not, and wherever in the world those rights may exist). You further acknowledge that the Services may contain information which is designated as confidential by Brusper and that you shall not disclose such information without Brusper's prior written consent. Unless you have agreed otherwise in writing with Brusper, nothing in the Terms gives you a right to use any of Brusper's trade names, trademarks, service marks, logos, domain names, and other distinctive brand features.

 

c. You agree not to use any framing techniques to enclose any trademark or logo or other proprietary information of Brusper; or remove, conceal or obliterate any copyright or other proprietary notice or source identifier, including without limitation, the size, colour, location orstyle of any proprietary mark(s). Any infringement shall lead to appropriate legal proceedings against you at an appropriate forum for seeking all available/possible remedies under applicable laws of the country of violation. You cannot modify, reproduce, publicly display or exploit in any form or manner whatsoever any of the Brusper's Content in whole or in part except as expressly authorized by Brusper.

d. To the fullest extent permitted by applicable law, we neither warrant nor represent that your use of materials displayed on the Services will not infringe rights of third parties not owned by or affiliated with us. You agree to immediately notify us upon becoming aware of any claim that the Services infringe upon any copyright trademark, or other contractual, intellectual, statutory, or common law rights by following the instructions.

We analyse the log files of our Brusper Platform that may contain Internet Protocol (IP) addresses, browser type and language, Internet service provider (ISP), referring, app crashes, page viewed and exit websites and applications, operating system, date/time stamp, and clickstream data. This helps us to administer the website, to learn about user behavior on the site, to improve our product and services, and to gather demographic information about our user base as a whole.

DATA SECURITY PRECAUTIONS:

Refund , Cancellation, Return, Shipping Policy

Return

Product must be returned to us within 15 days from the date it has been delivered to the customer. Product must be returned with all tags attached in its original condition along with all packing material, courier receipt, invoice & other papers.

Refund and Cancellation for Service Provider Company

 

Due to service providers in nature “NO REFUND”, “NO CANCELLATION” will be entertained once the Payment has been made.

 

Cancellation Policy

Please note an order can only be canceled within 24 hours of placing the order. Once the order is processed after 24 hours, no cancellation request will be entertained. However return is possible for all orders/products.

Customers can CANCEL order only before the Order has been shipped/Dispatched. After the Product/s have been shipped, The Customer CANNOT Cancel the Orders. However return is possible for all orders/products.

 

Shipping & Delivery Policies -

brusper.com ships its products to almost all parts of India. Orders placed will be shipped within 24* hrs. We ship on all days except Sunday and National Holidays.

For all areas serviced by reputed couriers, the delivery time would be within 3 to 4 business days of shipping (business days exclude Sundays and other holidays). For other areas the products will be shipped through --------------- and may take 1-2 weeks depending on location. At times there might be unexpected delays in the delivery of your order due to unavoidable and undetermined logistics challenges beyond our control for which --Company Name--is not liable and would request its users to cooperate as brusper.com continuously tries to nought such instances.
